These Terms of Service ("Terms") govern your access to and use of the MUSIAC app, website, platform and related services available at www.musiac.live and any related pages, features, content or services we provide from time to time. The platform is operated by Musiac Events Management, Sri Lanka ("MUSIAC", "Musiac", "we", "us" or "our"). By accessing, browsing, creating an account, signing in, submitting content, listing an event, saving an event, clicking "accept", or otherwise using MUSIAC, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use MUSIAC. For questions about these Terms, contact us at support@musiac.live.
1. What MUSIAC is
MUSIAC is an event discovery platform designed to help users find live music, theatre, comedy, exhibitions, open mic nights, cultural activities, artistic experiences, venue-based entertainment and other events.
MUSIAC may display events, venues, artists, organisers, maps, recommendations, sponsored listings, promotional content, advertisements and related information.
Unless we expressly state otherwise, MUSIAC is an event discovery and information platform only. We are not the organiser, promoter, venue operator, ticket seller, artist, performer, security provider, transport provider or payment processor for events listed on the platform.
Event information may be provided by event organisers, venues, promoters, artists, users, third-party sources, public sources, partners or other service providers. We do not guarantee that any event information is complete, accurate, current or suitable for your personal circumstances.
2. Privacy Policy
Your use of MUSIAC is also governed by our Privacy Policy.
Our Privacy Policy explains how we collect, use, store and share information, including account information, saved events, location information, usage behaviour, app interactions, technical information and information used for personalisation, sponsored content, advertising, analytics and aggregated or de-identified commercial insights.
By using MUSIAC, you acknowledge that we may process information in accordance with our Privacy Policy, including to:
- operate and secure the platform;
- personalise your experience;
- recommend events, venues, artists and categories;
- show promoted events, sponsored listings, advertising or commercial content;
- measure engagement and campaign performance;
- create aggregated, de-identified or anonymised insights;
- help event organisers, venues, artists, promoters, sponsors and commercial partners understand audience interest and improve their services.
If you do not agree with our Privacy Policy, you must not use MUSIAC.
3. Changes to MUSIAC
We may update, change, suspend, limit, replace or discontinue any part of MUSIAC at any time. This includes changes to features, maps, event categories, event listings, recommendation systems, account features, saved event functionality, advertising or sponsorship features, organiser tools, pricing, free or paid functionality, and integrations with third-party services.
MUSIAC is currently made available free of charge to users, but we reserve the right to introduce paid features, paid organiser tools, subscriptions, commissions, ticketing fees, promoted listings, advertising products, sponsorship packages or other commercial services in the future.
We are not liable to you for any change, suspension or discontinuation of MUSIAC or any part of the platform.
4. Eligibility and age requirements
You must be at least 13 years old to use MUSIAC. If you are under 18, you may only use MUSIAC with the consent and supervision of a parent or legal guardian. By using MUSIAC, you confirm that you satisfy this requirement.
Some events listed on MUSIAC may have age restrictions, entry requirements, dress codes, identification requirements or other conditions. You are responsible for checking and complying with those requirements before attending an event or purchasing any ticket.
We are not responsible if you are refused entry to an event because you do not satisfy the organiser's, venue's or applicable legal requirements.
5. Your account
You may need an account to access certain MUSIAC features, including saving events, personalising your map, submitting events or using organiser features. You agree that:
- the information you provide must be accurate, current and complete;
- you will keep your account information up to date;
- you will keep your login credentials secure;
- you will not share your account with another person;
- you will not create accounts using false, misleading or unauthorised information;
- you will not impersonate another person, organisation, venue, artist or event organiser;
- you are responsible for all activity that occurs through your account.
If you believe your account has been compromised, contact us promptly at support@musiac.live. We may suspend, restrict or terminate your account if we reasonably believe you have breached these Terms, created risk, misused the platform, submitted false information, infringed rights, or acted unlawfully.
6. Acceptable use
You must use MUSIAC lawfully, responsibly and only for its intended purpose. You must not:
- use MUSIAC for any unlawful, misleading, harmful, abusive or fraudulent purpose;
- submit false, inaccurate, incomplete or misleading event information;
- impersonate any person, organisation, artist, venue, promoter or event organiser;
- misrepresent your authority to submit, manage or promote an event;
- interfere with the normal operation, security or availability of MUSIAC;
- attempt to gain unauthorised access to MUSIAC, our systems, accounts, databases, servers or networks;
- bypass, disable or interfere with any security, access control, rate limit or technical protection;
- scrape, crawl, harvest, copy, index, download, mine or extract data from MUSIAC without our prior written permission;
- use bots, scripts, automated tools or bulk extraction methods without our prior written permission;
- reverse engineer, decompile, modify or create derivative works from MUSIAC or its underlying software;
- upload malware, harmful code or malicious content;
- use MUSIAC to send spam, unsolicited messages or unauthorised promotional content;
- collect or misuse information about other users;
- infringe intellectual property, privacy, publicity or other legal rights;
- submit content that is defamatory, discriminatory, threatening, obscene, hateful or otherwise unlawful;
- use MUSIAC in a way that could damage our reputation, brand, systems, users, partners or commercial relationships;
- use MUSIAC in violation of Sri Lankan law or any other law that applies to you.
We may investigate suspected breaches and take action, including removing content, restricting access, suspending accounts, blocking access, reporting conduct to authorities or taking legal action.
7. Event listings and organiser content
Event listings may include names, descriptions, dates, times, venue details, ticket information, pricing, images, artwork, artist names, organiser details, categories, tags, links and other information.
If you submit, upload, provide, claim, manage or request publication of any event listing or organiser content, you represent and warrant that:
- the information is accurate, complete and not misleading;
- you have the right and authority to submit the content;
- you have obtained all necessary permissions, licences and consents;
- the content does not infringe any third-party rights;
- the event complies with all applicable laws, permits, venue rules and regulatory requirements;
- any ticketing, pricing, refund, entry, age, safety or access information you provide is accurate;
- you will promptly update us or the listing if event details change;
- you will not submit events that are fraudulent, unlawful, unsafe, misleading or unauthorised.
We may approve, reject, edit, format, categorise, moderate, remove, hide, rank, promote or decline to publish any event listing at our discretion. We are not required to publish any event. Publication of an event on MUSIAC does not mean we endorse, verify, sponsor, organise or guarantee that event.
8. Licence to submitted content
When you submit, upload, provide or make available content to MUSIAC, including event information, descriptions, images, logos, artist details, venue details, promotional material or other content, you grant MUSIAC a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to use, host, store, reproduce, display, publish, distribute, adapt, format, edit, promote, translate and otherwise use that content for the purpose of operating, improving, marketing, promoting and commercialising MUSIAC.
This licence includes the right to use submitted content on MUSIAC, in search and discovery features, in personalised recommendations, in sponsored or promoted placements, in email or marketing material, in partner reports, in analytics and performance reporting, in aggregated or de-identified commercial insights, and in promotional material for MUSIAC or the relevant event.
You retain ownership of the content you submit, but you give us the rights necessary to operate and promote the platform. You are solely responsible for ensuring you have the rights required to grant this licence.
9. Event accuracy, cancellations and changes
Event details may change at any time. Dates, times, venues, ticket prices, entry requirements, lineups, performers, schedules, accessibility information and other details may be changed, postponed, cancelled or updated by organisers, venues or third parties without notice.
You are responsible for confirming event details directly with the organiser, venue, ticketing provider or official event source before attending, travelling to, relying on or purchasing anything in connection with an event.
MUSIAC does not guarantee that an event will occur, that events will occur at the listed time or venue, that listed prices are current, that tickets will be available, that entry will be granted, that performers will appear as advertised, or that event information is free from error.
We are not liable for losses, expenses, travel costs, ticket costs, accommodation costs, missed events, disappointment, inconvenience or other harm arising from inaccurate event information, changes, postponements, cancellations or refused entry.
10. Tickets, payments and refunds
MUSIAC may display ticket links, booking links, organiser links, venue links or third-party purchase options. Unless we expressly state otherwise, ticket purchases, bookings, payments, refunds, cancellations and entry disputes are handled by the relevant organiser, venue, ticketing provider, payment provider or third-party seller.
We are not responsible for ticket availability, ticket pricing, booking fees, payment processing, refunds, chargebacks, cancelled events, postponed events, refused entry, lost tickets, duplicate tickets, ticket fraud by third parties, or disputes between users and organisers, venues or ticketing providers.
If MUSIAC introduces direct ticketing, paid features, organiser tools, subscriptions or other paid services, additional payment terms may apply. To the extent permitted by law, any platform fees, promotion fees, advertising fees, listing fees, subscription fees or service fees paid to MUSIAC may be non-refundable unless expressly stated otherwise.
11. Sponsored content, advertising and commercial placements
MUSIAC may display sponsored listings, promoted events, venue promotions, artist campaigns, advertisements, paid placements, branded content or other commercial material. Sponsored or promoted content may be influenced by factors including your approximate location, saved events, event views, searches, categories of interest, app interactions, popularity, commercial arrangements, organiser campaigns, sponsorship or advertising spend, and platform relevance and ranking logic.
We may receive payment, commission, fees, sponsorship value or other commercial benefit from organisers, venues, artists, promoters, advertisers, sponsors, partners or third-party providers. Unless expressly stated, sponsored or promoted content does not mean MUSIAC endorses or guarantees the event, organiser, venue, product or service.
You are responsible for assessing whether any event, offer, promotion, advertisement or third-party service is suitable for you.
12. Recommendations and ranking
MUSIAC may use algorithms, user preferences, saved events, location information, app activity, popularity signals, event data, commercial factors and other inputs to recommend, rank, sort or display events. Recommendations are provided for convenience and discovery only. They are not professional advice, personal advice, safety advice, travel advice or a guarantee that an event will be suitable for you.
We may change how events are ranked, recommended, displayed or promoted at any time. We do not guarantee equal visibility, ranking, placement, traffic, clicks, saves, attendance or commercial results for any organiser, venue, artist, sponsor or partner.
13. Third-party services and links
MUSIAC may rely on or link to third-party services, including authentication providers, cloud infrastructure providers, map providers, analytics providers, advertising providers, ticketing providers, payment processors, organiser websites, venue websites and social media platforms. Third-party services operate under their own terms, privacy policies and practices. We do not control and are not responsible for third-party services.
MUSIAC currently uses or may use reputable third-party providers including Google LLC for Google Sign-In; OpenStreetMap Foundation and OpenStreetMap contributors for map data; reputable third-party map tile, geospatial or rendering providers; reputable global cloud infrastructure providers; reputable analytics, monitoring and performance providers; reputable advertising, sponsorship, promotion or campaign measurement providers; and third-party ticketing, payment, booking or event management providers.
We are not liable for any loss, damage, error, outage, data handling, service interruption, fee, dispute or issue caused by a third-party provider. Your use of third-party services is at your own risk.
14. Location-based services
MUSIAC may use location information to show nearby events, map positions, venue proximity, personalised recommendations, promoted content, sponsored listings, audience insights and other location-based features. Location information may be based on device permissions, browser permissions, IP address, map interactions, search activity or other app activity.
You can disable device-level location permissions through your browser or device settings. If you disable location access, some features may not work properly.
You acknowledge that location information may be approximate, delayed, incomplete or inaccurate. We do not guarantee the accuracy of map positions, venue locations, distances, travel times or proximity features. You are responsible for verifying locations, routes, safety, transport options and venue access before attending any event.
15. Intellectual property
MUSIAC, including the MUSIAC name, logo, brand, design, interface, software, code, databases, features, layouts, recommendations, ranking methods, content created by us and other original materials, is owned by Musiac Events Management or its licensors.
Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable licence to access and use MUSIAC for its intended purpose. You must not copy, reproduce, distribute, sell, rent, sublicense or commercially exploit MUSIAC; modify, adapt, translate or create derivative works; reverse engineer or decompile MUSIAC; remove copyright, trademark or proprietary notices; use the MUSIAC name, logo or brand without our written permission; or use MUSIAC content to build a competing product, database, directory, map, event platform or commercial service.
All rights not expressly granted are reserved.
16. OpenStreetMap and map data
Map data displayed through MUSIAC may be sourced from OpenStreetMap contributors and licensed under the Open Database License. You must comply with applicable OpenStreetMap and Open Database License requirements when using, copying or reusing map data.
Map tiles, rendering, geocoding, routing or other map-related features may be provided by third-party providers and may be subject to separate terms, limits, licences and usage restrictions. MUSIAC does not guarantee the accuracy, completeness, availability or suitability of map data, map tiles, geocoding, venue locations, boundaries, distances or routes.
17. Intellectual property complaints
If you believe content on MUSIAC infringes your copyright, trademark or other rights, contact us at support@musiac.live. Please include your name and contact details; a description of the work, mark or right you claim is infringed; the URL or location of the allegedly infringing content; evidence that you own or are authorised to act for the owner of the rights; and a statement that the information you provide is accurate.
We may remove, disable or restrict access to content that we reasonably believe infringes rights or exposes MUSIAC to legal risk.
18. Platform moderation and enforcement
We may, at our discretion and without liability: review content; remove content; edit formatting or categorisation; reject event submissions; hide event listings; restrict accounts; suspend accounts; terminate accounts; block access; reduce visibility of content; mark content as sponsored or promoted; investigate suspicious activity; and cooperate with law enforcement or regulators where required.
We are not required to monitor all content, and we do not assume responsibility for content submitted by organisers, venues, promoters, artists, users or third parties. Failure to enforce any part of these Terms does not waive our right to enforce it later.
19. User responsibility for attending events
You are solely responsible for deciding whether to attend an event. You should consider your own circumstances, age, transport, health, accessibility needs, safety, venue rules, local laws, weather, timing and any other relevant factor before attending.
MUSIAC does not control event venues, organisers, staff, crowds, performers, security, transport, ticketing, access, food, facilities, accessibility arrangements or event conditions. You attend events at your own risk.
20. No warranty
MUSIAC is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we make no warranties, representations or guarantees, whether express, implied or statutory, including warranties of accuracy, completeness, reliability, availability, merchantability, fitness for a particular purpose, non-infringement, uninterrupted access, error-free operation, security, suitability of events, ticket availability, organiser reliability, venue quality, or commercial outcomes.
We do not guarantee that MUSIAC will always be available, secure, accurate, uninterrupted or free from bugs, errors, outages or harmful components.
21. Limitation of liability
MUSIAC is currently provided to users free of charge unless we expressly state otherwise for a specific paid feature, product or service.
To the maximum extent permitted by applicable law, Musiac Events Management, its founders, directors, officers, employees, contractors, agents, affiliates, partners, service providers and licensors are not liable for any direct, indirect, incidental, consequential, special, punitive or exemplary loss, damage, cost, expense or claim arising from or relating to your use of MUSIAC; your inability to use MUSIAC; event inaccuracies; event changes, postponements or cancellations; refused event entry; ticketing or payment disputes; third-party services; third-party links; sponsored content; organiser, venue, artist, promoter, advertiser, sponsor or user conduct; unauthorised access to your account; your failure to secure your login details; data loss; service interruptions; technical errors; location inaccuracies; map inaccuracies; content submitted by organisers, users or third parties; or any decision you make based on MUSIAC content.
Where MUSIAC is provided free of charge, you acknowledge and agree that, to the maximum extent permitted by applicable law, MUSIAC has no obligation to pay you any compensation, refund, reimbursement, damages, credits or other amount in connection with your use of, or inability to use, the platform.
If MUSIAC introduces a paid feature, product or service and you pay MUSIAC directly for that specific paid feature, product or service, then to the maximum extent permitted by applicable law, our total aggregate liability to you for claims relating to that specific paid feature, product or service is limited to the greater of: the amount of your most recent single payment made directly to MUSIAC for that specific paid feature, product or service; or the total amount you paid directly to MUSIAC for that specific paid feature, product or service in the 30 days immediately before the claim arose.
For clarity, amounts paid to third-party organisers, venues, ticketing providers, payment providers, advertisers, sponsors, artists, promoters or other third parties are not amounts paid to MUSIAC and do not create any liability, refund obligation or reimbursement obligation for MUSIAC.
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under applicable law.
22. Indemnity
You agree to indemnify and hold harmless Musiac Events Management, its founders, directors, officers, employees, contractors, agents, affiliates, partners, service providers and licensors from and against any claims, losses, liabilities, damages, costs and expenses, including reasonable legal costs, arising from or relating to your use or misuse of MUSIAC; your breach of these Terms; your breach of any law; your infringement of third-party rights; content you submit, upload, provide or make available; events you submit, manage, promote or organise; false, inaccurate or misleading information you provide; disputes between you and any user, organiser, venue, artist, promoter, sponsor, advertiser, ticketing provider or third party; or your unauthorised scraping, copying, extraction or commercial use of MUSIAC data.
This indemnity continues after your account is suspended, terminated or deleted.
23. Suspension and termination
We may suspend, restrict or terminate your access to MUSIAC at any time if we reasonably believe that you have breached these Terms, misused the platform, submitted false, misleading, infringing or unlawful content, your activity creates legal, security, operational or reputational risk, your account has been compromised, we are required to do so by law, or continuing to provide access would be harmful to MUSIAC, users, partners or third parties.
You may stop using MUSIAC at any time. You may request account deletion by contacting support@musiac.live.
Sections that by their nature should continue after termination will continue, including intellectual property, submitted content licences, disclaimers, limitation of liability, indemnity, governing law and dispute provisions.
24. Communications and notices
We may contact you by email, in-app notice, website notice or other reasonable method using the contact details associated with your account. You consent to receiving electronic communications from us in relation to MUSIAC, including service notices, security notices, policy updates, account notices and legally required communications. You are responsible for keeping your email address current.
25. Force majeure
We are not liable for delay, failure, interruption, outage or non-performance caused by events beyond our reasonable control, including internet outages, cloud provider outages, power failures, cyber incidents, third-party service failures, natural disasters, extreme weather, civil unrest, government action, strikes, regulatory changes, public health events, war or conflict, venue closures, or organiser cancellations.
26. Users outside Sri Lanka
MUSIAC is operated from Sri Lanka. We may make the platform available to users outside Sri Lanka, but we do not represent that MUSIAC is appropriate, lawful or available in every country. If you access MUSIAC from outside Sri Lanka, you are responsible for complying with local laws that apply to you. We may restrict access to MUSIAC from certain countries, regions or users at our discretion.
27. Governing law and disputes
These Terms are governed by the laws of Sri Lanka, without regard to conflict of law principles. Subject to any mandatory law that applies to you, the courts of Sri Lanka have exclusive jurisdiction over any dispute, claim or proceeding arising out of or relating to these Terms, MUSIAC, your account, your use of the platform, or any content or service made available through MUSIAC.
Before starting formal legal proceedings, you agree to first contact us at support@musiac.live and give us a reasonable opportunity to resolve the issue.
Nothing in these Terms prevents us from seeking urgent injunctive, equitable or protective relief in any court of competent jurisdiction where necessary to protect our intellectual property, confidential information, systems, users, partners or legal rights.
28. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
29. Assignment
You may not assign, transfer or delegate your rights or obligations under these Terms without our prior written consent. We may assign, transfer or delegate our rights and obligations under these Terms in connection with a merger, acquisition, restructuring, sale of assets, financing, corporate transaction, change of control or transfer of the MUSIAC business.
30. Entire agreement
These Terms, together with our Privacy Policy and any additional terms presented for specific features or services, form the entire agreement between you and Musiac Events Management regarding your use of MUSIAC. They replace any prior or inconsistent understandings, communications or agreements relating to MUSIAC.
31. Changes to these Terms
We may update these Terms from time to time. When we update these Terms, we will change the effective date at the top of this page. If we make material changes, we may notify registered users by email, in-app notice or website notice where required or appropriate.
Your continued use of MUSIAC after updated Terms take effect means you accept the updated Terms. If you do not agree to the updated Terms, you must stop using MUSIAC.
